Sax and the Second Republic Sax’s business prospered in the years immediately after the Champs de Mars event, notwithstanding the various legal challenges mounted against him. A bad cereal harvest in 1845 was compounded by a much worse harvest generally in 1846. Bread and potatoes were in short supply and a full-blown agricultural crisis developed.

Only the patent covering the saxophone was upheld in full. Sax appealed, however, and the case had several further hearings before finally coming to a conclusion at Rouen in 1854, with the court finding in favour of Sax and deeming his patents to be valid. 63 Although the decision of the court in Rouen brought this particular piece of litigation to a close, Sax immediately filed a counter-suit against his opponents, in a series of actions that occupied him over the next decade.

The Ministry of War itself, however, took a slightly different view. In the official instrumentation published on 10 September 1845 they largely followed the commission’s recommendation, but omitted the oboes and bassoons. 45 For Sax the outcome was highly satisfactory.
